Welcome to Bright & Happy! These Terms & Conditions (“Terms”) govern your access to and use of the Bright & Happy website, as well as your purchase, download, and use of our products.
By accessing our website, purchasing a product, or downloading or using a Bright & Happy pattern, you agree to these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.
Digital Products
Bright & Happy primarily sells digital sewing patterns and other downloadable products. Unless a product listing specifically states otherwise, no physical product will be shipped to you.
After completing your purchase, you will receive access to your digital product using the email address provided at checkout. You are responsible for providing a valid and accurate email address and for downloading and securely storing your purchased files.
If you experience a technical issue accessing a purchased file, please contact us and we will make reasonable efforts to assist you.
All Sales Are Final
Because our digital products are delivered electronically and customers receive access to the purchased content after completing an order, all sales of digital products are final.
We do not accept returns, exchanges, or cancellations and do not provide refunds for digital products once an order has been completed, except where required by applicable law.
Please carefully review the product description, required materials, measurements, skill level, and other information before purchasing.
If you accidentally purchase the same product more than once or experience a legitimate technical problem with your order, please contact us. Bright & Happy may, at its sole discretion, make an exception to this policy where appropriate. Making an exception in one situation does not require Bright & Happy to make an exception in another.
License & Permitted Use
When you purchase a Bright & Happy digital pattern, you are purchasing a limited license to use the pattern, not ownership of the pattern or its intellectual property.
Unless otherwise stated, the license is granted only to the original purchaser.
You may download and print reasonable copies of the pattern for your own use.
You may not:
Share the digital pattern file with another person.
Email, text, upload, transfer, or otherwise distribute the pattern to another person.
Upload the pattern or any portion of it to a website, social media platform, file-sharing service, online group, shared drive, or other digital location for others to access.
Photocopy or reproduce the pattern for distribution to others.
Sell, sublicense, redistribute, or give away the pattern.
Purchase one copy for use by an entire sewing group, class, club, or organization unless Bright & Happy has provided written permission.
Repackage, modify, translate, trace, redraw, digitize, or otherwise adapt a Bright & Happy pattern for the purpose of distributing, publishing, or selling the resulting pattern or instructions.
Claim a Bright & Happy pattern, design, instructions, illustrations, or templates as your own.
If another person would like to use a Bright & Happy pattern, please direct them to purchase their own copy.
Selling Finished Items Made From Our Patterns
Bright & Happy patterns may be used to create finished handmade items for personal use or for sale on a small-business, handmade scale.
You are welcome to sell finished items that you personally make using a Bright & Happy pattern, including through a small business, online shop, craft fair, market, boutique, or similar handmade venue.
This permission applies only to finished physical items created from the pattern. It does not grant permission to sell, distribute, or reproduce the pattern itself.
Mass production, factory production, commercial manufacturing, or manufacturing by third parties is not permitted without prior written permission from Bright & Happy.
Bright & Happy reserves the right to determine whether a particular use falls outside the intended scope of this small-business license.
When possible, we appreciate credit such as “Made using a Bright & Happy pattern,” but credit is not required for permitted sales of finished handmade items.
Classes, Workshops & Sewing Groups
Purchasing one copy of a Bright & Happy pattern does not grant permission to reproduce or distribute copies for a class, workshop, sewing group, guild, retreat, or other group.
Unless Bright & Happy provides written permission otherwise, each participant must purchase their own copy of the pattern.
Teachers and organizers may demonstrate techniques used in the pattern but may not reproduce, distribute, display, or provide the complete pattern or pattern instructions to participants who have not purchased a copy.
Copyright & Intellectual Property
All Bright & Happy patterns and website content, including but not limited to written instructions, pattern pieces, templates, diagrams, illustrations, photographs, graphics, logos, product names, branding, website copy, and downloadable materials, are owned by or licensed to Bright & Happy and are protected by applicable intellectual property laws.
Except for the limited permissions expressly provided in these Terms, no content may be copied, reproduced, republished, distributed, sold, licensed, or commercially exploited without prior written permission from Bright & Happy.
Pattern Accuracy & Corrections
We take care in designing, writing, illustrating, and testing our patterns. However, sewing patterns are detailed creative products, and occasional typographical errors, measurement errors, omissions, or other mistakes may occur.
Bright & Happy reserves the right to correct, revise, clarify, or update patterns at any time.
Where appropriate, we may publish corrections or updated versions of a pattern.
The existence of an error, correction, clarification, or subsequent pattern update does not automatically entitle a purchaser to a refund.
Customer Modifications
Bright & Happy patterns are designed and tested according to the instructions, dimensions, materials, and construction methods provided.
If you alter measurements, substitute materials, resize pattern pieces, change construction methods, omit steps, add features, or otherwise modify a pattern, your results may differ from those shown or described.
Bright & Happy is not responsible for unsuccessful projects, fit or sizing issues, material loss, or other results arising from customer modifications or deviations from the pattern instructions.
Fabric, Materials & Finished Results
Finished results may vary based on fabric, interfacing, batting, thread, hardware, equipment, printing, sewing experience, seam allowance, cutting accuracy, modifications, and other factors outside Bright & Happy's control.
Photographs and samples are provided for inspiration and illustration. We cannot guarantee that every finished project will look exactly like a photographed sample.
Customers are responsible for determining whether their selected fabrics, materials, hardware, and construction techniques are suitable for their intended use.
Printing & Technology Requirements
Customers are responsible for having appropriate equipment and software necessary to access, view, download, and print digital products.
When printing a Bright & Happy pattern, customers are responsible for following the printing instructions and verifying scale before cutting fabric.
Bright & Happy is not responsible for sizing, fit, construction, or material loss resulting from incorrect printer settings, scaling, paper size, printer calibration, software settings, or other printing or technology issues outside our control.
Sewing, Tools & Safety
Sewing and crafting may involve sewing machines, irons, rotary cutters, scissors, needles, pins, adhesives, hardware, hot surfaces, sharp objects, and other tools and materials that can cause injury if used improperly.
By using a Bright & Happy pattern, you acknowledge that you are responsible for using appropriate tools, equipment, materials, and safety precautions.
Always follow the safety instructions provided by the manufacturer of your sewing machine, iron, cutting tools, adhesives, hardware, and other equipment or materials.
Children should be appropriately supervised when participating in sewing or crafting activities.
Intended Use of Finished Products
Unless specifically stated otherwise, Bright & Happy patterns are intended for general sewing and crafting purposes.
Customers are responsible for determining whether a finished item is appropriate and safe for its intended purpose and user.
Bright & Happy does not represent that finished products created from our patterns meet any particular regulatory, safety, commercial, child-safety, load-bearing, or industry standard unless expressly stated otherwise.
No Professional Advice
Information provided through Bright & Happy patterns, tutorials, website content, social media, emails, or other materials is provided for general sewing, crafting, and informational purposes.
It should not be interpreted as professional engineering, product-safety, legal, financial, medical, or other specialized professional advice.
Product Availability & Discontinuation
Bright & Happy may modify, update, replace, or discontinue any product at any time.
We do not guarantee that a particular digital product will remain available for purchase or re-download indefinitely.
Customers are encouraged to download purchased products promptly and maintain their own backup copies.
Website & Product Information
We make reasonable efforts to provide accurate product descriptions, pricing, measurements, photographs, and other information.
However, occasional typographical, technical, pricing, or other errors may occur.
Bright & Happy reserves the right to correct errors or omissions and update information at any time.
If an obvious pricing or technical error affects an order, Bright & Happy reserves the right to cancel the affected transaction and, when applicable, refund the amount paid.
Payments
Payment must be completed at checkout before access to a digital product is provided.
You agree to provide current, complete, and accurate billing and payment information.
You represent that you are authorized to use the payment method submitted for your purchase.
Chargebacks & Payment Disputes
If you believe there is a problem with an order or charge, we encourage you to contact Bright & Happy first so that we have an opportunity to investigate and assist.
Fraudulent chargebacks, knowingly false payment disputes, or abuse of the payment dispute process may result in restriction of future purchases or access to Bright & Happy services, to the extent permitted by law.
Nothing in this section limits any legitimate rights you may have through your payment provider or applicable consumer protection law.
Promotions & Discount Codes
Promotional offers and discount codes may be subject to additional terms, expiration dates, product restrictions, or usage limits.
Unless otherwise stated, discounts cannot be applied retroactively to previous purchases or combined with other promotions.
Bright & Happy may modify or discontinue promotions at any time, subject to applicable law.
User-Submitted Photos & Content
We love seeing your Bright & Happy projects!
If you tag Bright & Happy on social media or send us photographs of your projects, we may ask for your permission before using your content for promotional purposes.
Unless otherwise agreed, you retain ownership of your original photographs and other original content.
Submission of content does not transfer ownership of that content to Bright & Happy.
Third-Party Links & Services
Our website may contain links to or use services provided by third parties, including website hosting, payment processing, email communications, social media platforms, and other service providers.
Bright & Happy does not control third-party websites or services and is not responsible for their content, availability, security practices, or separate terms and policies.
Website Availability
We do not guarantee that the Bright & Happy website or digital delivery systems will be available continuously or without interruption.
Access may occasionally be unavailable due to maintenance, technical problems, third-party service outages, circumstances beyond our control, or other reasons.
Temporary website or download interruptions do not automatically entitle a customer to a refund.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Bright & Happy website, patterns, downloads, and related content are provided “as is” and “as available.”
Bright & Happy makes no warranties, express or implied, regarding a particular finished result, commercial outcome, suitability for a particular purpose, or compatibility with every material, machine, printer, device, or software configuration.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Bright & Happy and its owners, members, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the website, patterns, digital products, or their use.
This includes, where permitted by law, losses involving materials, fabric, supplies, equipment, business opportunities, profits, data, or time.
To the fullest extent permitted by applicable law, Bright & Happy's total liability arising from a purchased product will not exceed the amount actually paid to Bright & Happy for the product giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Bright & Happy and its owners, members, employees, contractors, and representatives from claims, liabilities, damages, losses, or expenses arising from your unlawful use of our website or products, your violation of these Terms, your infringement of another person's rights, or finished products that you manufacture, market, or sell using a Bright & Happy pattern.
Enforcement
Bright & Happy's decision not to enforce a provision of these Terms in one instance does not waive our right to enforce that provision in the future.
If we become aware of unauthorized distribution, resale, reproduction, or other infringement of our patterns or intellectual property, we reserve the right to take appropriate action to protect our rights.
Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
Entire Agreement
These Terms, together with any policies referenced on our website, constitute the agreement between you and Bright & Happy regarding your use of the website and purchase and use of our products, except where additional written terms expressly apply.
Changes to These Terms
Bright & Happy may update these Terms from time to time.
Changes will be posted on this page with an updated “Last Updated” date. Changes will apply prospectively as required by applicable law.
Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
